Terms & Conditions
The terms and conditions below are legally binding on You ("Customer" or "You") as a user of the Stauer Gold Redemption Services Program ("We" or "Us"). These terms and conditions are subject to change without prior notice. Any new changes will be available on the website (
www.stauergoldredemption.com) and will go in effect as soon as they are posted online. The items that You send to Us are referred to herein collectively and individually as "Items".
Requirements for Use
Every Customer must be at least eighteen (18) years of age to use the Program. You must be the lawful owner of any Items sold and intended to be sold to Us without acting as agent and/or under authorization of the actual owner. In our sole discretion, We may at any time require proof of or compliance with the requirements set forth in this paragraph.
Offers
Every Customer agrees that any offer that is made by Stauer Gold Redemption Services is valid for seven (7) business days from receipt of the offer. If the offer is not accepted or rejected within the seven (7) business day period, the offer will be automatically accepted. Within five (5) business days after acceptance of the offer, payment will be made. Any offer made by Gold Redemption Services is deemed by the Customer to provide sufficient consideration for the transaction(s) contemplated hereunder, is deemed made without any representations of any kind, is deemed made without subjecting Stauer Gold Redemption Services to any liability whatsoever relating to such offer, and is made without any warranty as to the value of any submission by the Customer. Stauer Gold Redemption Services makes no representation that an offer reflects the market value of any item submitted and the Customer waives any claims or potential claims against Stauer Gold Redemption Services relating in any way to any offer and/or its propriety.
Guaranty against Loss
In the event that You ship your Items in accordance with the instructions and shipping procedures set forth by Us, then We will guaranty against loss of the total contents properly shipped to Us in accordance with the instructions and procedures established by Us and subject to these terms and conditions. We reserve the right to reject any mail, envelope or package that appears to be damaged, opened, or tampered with, and any such mail, envelope or package will be delivered to a common carrier to be returned to You. We shall have no liability to You for any such attempted delivery or return of any such items.
Waiting Period for a Claim
Each claim of loss shall be subject to a twenty (20) day waiting period so that We will have the opportunity to investigate such claim.
Limitation of Liability
We, will not be liable for (a) any incidental, indirect, special, consequential, punitive damages, or loss of profit or opportunity; (b) claims, demands, or actions for any subrogation claim brought by your insurance carrier, and, by submitting Items to Us, You expressly and specifically waive any such subrogation claim as well as on behalf of your insurance carrier. Your exclusive remedy with respect to any claim made under or in connection with the Program is and shall be expressly and specifically limited to a maximum of the least of the following sums:
- The liquidation value placed on the total contents by Us in our sole discretion;
- One third (1/3) of the appraised value of the contents according to an independent appraisal submitted by You to Us, which appraisal was issued prior to the shipment of the Items to Us; or
- The sum of Two Hundred U.S. Dollars ($200.00)
You expressly acknowledge and agree that if there is no appraisal which was issued prior to the contents being submitted, our stated liquidation value shall be conclusive and binding and further, in no event shall our liability exceed Two Hundred Dollars ($200.00). By sending Items, You explicitly and expressly accept this limitation of liability.
Disclaimers and Notices
We do not evaluate or price collectibles, stones or any non-gold items (including gold-plated items). We make no representations as to the taxability of the transaction(s) contemplated hereunder and You explicitly accept all responsibility for any tax liability resulting directly or indirectly from any transaction with Us. The price of gold fluctuates frequently. Your payment will be based on a discount from the market price of gold using the PM London Gold Fixed Rate.
Return Insurance Liability
We will insure any Items returned to You with a value, as determined by Us in our sole discretion, for the greater of $15.00 or two (2) times the appraised value up to $200 (regardless of whether and in what amount such Items were insured for when mailed by You). We will not insure any Items with a value of less than $15.00. We will, in our sole discretion, choose the return carrier, insurance and receipt verification method for each transaction. Except for such insurance obligation, We will have no liability whatsoever in connection with the return of any Items to You.
Choice of Law, Waiver, and Claims
This Agreement shall be governed by the laws of the State of Minnesota without regard to its conflict of law principles. Our failure to exercise or enforce any right or provision under these terms and conditions will not be deemed to be a waiver of such right or provision. If any provision of these terms and conditions are found by a court of competent jurisdiction to be invalid, the court shall modify said provisions to effectuate the parties' intentions, and the other provisions set forth in these terms and conditions remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to any transaction must be filed within one (1) year after such claim or cause of action arose or be forever barred. Any such claim or cause of action must be filed in the State of Minnesota. We shall be entitled to reimbursement for any and all costs incurred by us in defending any civil action filed or attempted to be filed in any jurisdiction outside of the State of Minnesota, including but not limited to, attorney's fees incurred by the gold redemption program.
